The
Terms & Conditions
The following terms and conditions are in place to protect
and help you and Triumphriders NZ Ltd. They might be
in the usual
small-print but we strongly advise you read them to ensure
you are familiar with the requirements of the agreement.
Licence and minimum Age
A valid full national driver’s licence is required. This
should be the paper version showing any endorsements. National
driver’s licences, which are not in English, need to be
presented in conjunction with an official translation or valid
international drivers licence. All hirers must be a minimum of
25 years of age and have held a full motorcycle license for at
least 3 years. If you have held a motorcycle license for less
than 3 years but are an experienced biker then get in touch and
we will see if we can help out.
New Zealand Traffic Laws
The motorcycle rider/hirer is responsible for all traffic
fines. If the hirer does not comply with New Zealand traffic
laws,
the contract can be cancelled by Triumphriders NZ Ltd at
any time
and the motorcycle must be returned with immediate effect.
Standard Excess Policy:
All Triumphriders NZ Ltd motorcycles come with comprehensive
insurance cover. A standard excess of NZ$ 3,000 applies
in the event of any damage to either the motorcycle or third
party property.
The renter will be fully liable for replacing or repairing
damaged tyres. A security bond of NZ$ 3,000 will be taken
on vehicle
collection. The security bond can be paid by cash, traveller's
cheque or credit card. Should the bond be paid by credit
card the amount will be debited to your account immediately,
any
currency fluctuations are not the responsibility of Triumphriders
NZ.
The bond is fully refundable on return of the motorcycle
to the agreed location, on the agreed date, with no damage
incurred
to the Triumphriders NZ Ltd motorcycle or third party property
and no items are lost or damaged.
IMPORTANT:
The renter is fully liable for any damage to the Triumphriders
NZ Ltd motorcycle or third party property if:
The terms of the rental contract are breached
Damage to the motorcycle is caused by careless, wilful
or reckless driving
Driving under the influence of alcohol or drugs
Driving on restricted roads
Water submersion or salt water damage caused through own
fault
Road Restrictions
All Triumphrider NZ Ltd motorcycles must only be driven
on sealed/bitumen or well maintained roads.
Reservation and Deposit:
At time of booking a deposit of 25% of the total cost
of the hire is required. The deposit should be paid
in NZ$
to secure
the booking. The balance is due 60 days prior to
commencement of the hire. If the balance is not received
60 days
prior to commencement of the hire, Triumphriders
NZ Ltd reserves
the
right to treat the booking as cancelled. In this
case the deposit is
non-refundable.
Cancellation Fees:
If a booking is cancelled more than 60 days prior
to commencement no cancellation fee applies. Cancellation
fees are charged
in percentage of the advertised Gross Rate as follows:
60 to 36 days before tour start = 50%
35 to 0 days before tour start and no show = 100%
If vehicle is returned early = No Refund available
Triumphriders NZ Ltd strongly recommends that you
insure yourself fully against cancellation with
a good travel
insurance policy
purchased by yourself.
Change of Motorcycle:
If, for reasons beyond our control, the booked motorcycle is
not available, we reserve the right to substitute a comparable
or superior motorcycle at no extra cost to the client. If a
comparable or superior motorcycle cannot be provided, a pro
rated refund for the difference in models will be paid. The
above shall not constitute a breach of contract and does not
entitle the participant to any additional refund.
Late returns
If a motorcycle is not returned on return date as advised
on the Booking Form or agreed with Triumphriders NZ Ltd,
we reserve
the right to apply a penalty charge of NZ$300 per day until
the motorcycle is returned to our premises undamaged. This
will be
deducted from the security ‘bond’ deposit which is
lodged with us before the tour commencement (see Insurance).
Termination of agreement:
Triumphriders NZ Ltd have the right to terminate the agreement
with persons failing to comply with the terms and conditions
of the rental agreement, or should the motorcycle be damaged.
The termination of the hire under the authority of this clause
shall be without prejudice to the other rights of the owner
and the rights of the hirer under this Agreement or otherwise.
Responsibilities and Liability:
We reserve the right to modify any part of a tour in the
interests of improvement or to adapt to other situations
as they arise.
We will not be held responsible or liable for expenses
incurred as a result of delays in flights or missed connections.
We will not be held responsible or liable for any delays
or any changes in the schedule in response to unplanned
events.
We will not be held responsible or liable for any accidents
and/or bodily injury or death, resulting from the use of
a motorcycle,
and riders and passengers indemnify all such claims against
us, and our employees.
We are not responsible for any Act of God, strikes, theft
or other conditions beyond our control.
We are not responsible or liable for any property lost
or damaged while using a rental motorcycle.
Motorcycles and Maintenance
In accordance with New Zealand Land Transport Safety Authority
regulations, Triumphriders NZ Ltd is a transport service
licence holder, and authorised to operate a rental service.
We must
ensure that all of our motorcycles are properly maintained
and that
any normal legal requirements are met. This includes
paying all fees, and having the motorcycles available for
inspection
by
the authorities at any time.
All motorcycles available for hire are regularly serviced
and maintained to a quality standard by experienced motorcycle
technicians.
Rental Agreement
As the holder of a rental service licence, Triumphriders
NZ Ltd and the hirer (i.e. the customer) must enter into
an agreement
for the hire of the vehicle which is in the terms set
out in the Annex to these rules in the Transport Services
Licensing
Act 1989.
General
Any claims or legal action in connection with the provision
of our services to the client will be governed by the laws
of New
Zealand. Any claim or legal action against the suppliers is
likely to be subject to the terms and conditions of our contract
with
them.
